- You rent a physical server for a term of 1, 3, 6 or 12 months, prepaid from a crypto balance. The price is the published cost sheet, and it is locked for as long as the server keeps renewing.
- Renewal is automatic. If the balance is short, the server stays online for 72 hours, is then powered off with its data kept for 14 days, then wiped.
- Unused balance is refundable to the address it came from. Rent already charged is not, except through SLA credits or when we fail to deliver.
- There is no identity check. You are responsible for what runs on your server, and the acceptable-use policy applies.
- Availability is 99.9% per server per month, credited ten times over, automatically.
1. Who we are and what this covers
DediGPU (“we”, “us”) rents dedicated GPU servers by the month from data centres in Iceland, Finland, the Netherlands and Singapore. These terms, together with the acceptable-use policy, the privacy policy and the service level agreement, are the whole agreement between you and us. You accept them by creating an account, and again each time you order a server.
If a term in a policy contradicts these terms, the policy wins for its subject: the SLA for availability, the AUP for what may run on a server, the privacy policy for data.
2. Your account
An account is an email address and a password. We do not ask for a name, documents, a phone number or a card, at any spend level. You must be at least 18 and legally able to enter a contract; a company may hold an account through a person authorised to act for it.
You are responsible for keeping the password and any API token secret, and for everything done with them. There is no “forgot password” email and no recovery code: a lost password cannot be reset, and the balance on that account cannot be moved. We cannot bypass this by design.
We may refuse or close an account that breaches these terms, that was opened to evade an earlier closure, or that we are legally required to close.
3. Balance and payments
Servers are paid from a prepaid balance held in US dollars. The balance is funded in cryptocurrency through a payment processor: you choose a coin, we show an address and an amount, and the balance is credited once the network has confirmed the transfer. The minimum top-up is $40; the maximum per invoice is published on the top-up page.
The exchange rate is fixed when the invoice is created and holds for the invoice's validity window. A transfer that arrives short is credited at the value received. A transfer that arrives after the window is credited at the rate of the moment it is seen. We accept no fiat, no cards and no bank transfers.
The balance is not a deposit account: it earns no interest, it is not insured and it can only be spent on our services or refunded as described below.
4. Ordering and the term
When you order a server you choose a term of 1, 3, 6, 12 months. The whole term is taken from your balance at once and the server is provisioned. The per-month price is the published cost sheet for a one-month term, and 3 %, 6 % and 10 % lower for 3, 6 and 12-month terms, on the server and its options alike. Any Windows licence is billed at our rate on top.
The monthly price of a server is locked when you order it, and stays locked for as long as the server renews without interruption. Changing the configuration (cards, options, region) is a new order with the price of that day.
A single-card server is normally online within under 5 minutes; an eight-card node within fifteen. If a server is not online 24 hours after the order, you may cancel it for a full refund of that order to your balance.
5. Renewal, grace, suspension, cancellation
At the end of the term the same term is taken from your balance again, at the locked price, and the server continues. If the balance does not cover it, the server stays online for 72 hours while you top up. After that it is powered off and its data kept for 14 days; if the balance is topped up during those days, resuming the server charges one term and brings it back as it was. After 14 days the server is cancelled and its storage is wiped.
You may turn automatic renewal off at any time: the server then stops at the end of the paid term and is wiped 14 days later. You may cancel a server at any time; cancellation takes effect immediately and the remainder of the paid term is not refunded. You may extend a running server by any number of terms in advance.
6. Refunds
Unused balance is refundable on request, in the coin it was paid with, to the address it came from, less network fees. We process refunds within seven days. Balance credited as a promotional or SLA credit is not refundable in cash.
Rent that has been charged for a term is not refundable, except: the SLA credits described in the service level agreement; a server we failed to deliver within 24 hours; a hardware failure we could not repair within 24 hours, in which case the remainder of the current term is refunded to your balance.
7. What you get, what you must do
You get exclusive use of a physical server: its GPUs, CPU cores, memory, NVMe and network port, with root access, an IPMI console and an API token. No other tenant runs on it. We do not access the operating system or the data on it.
You administer the server. Security updates, backups, firewall rules and the software you install are yours. We keep no backup of your data; a failed drive can mean lost data, and the answer to that is your own backup. We can re-image a server on request from the console; that wipes it.
8. Acceptable use
The acceptable-use policy is part of these terms. When we receive a credible report of a breach we forward it to you and expect an answer within 24 hours. Ongoing harm to third parties, to other tenants or to our network is stopped immediately by suspending the server. Repeated or serious breaches end the agreement without refund.
9. Support
Support is provided through tickets in the console, to accounts that have a server online. We answer around the clock; a first reply usually arrives within an hour and always within eight. Hardware faults detected by our monitoring are handled without a ticket. Everyone gets the same support: there is no paid priority tier.
10. Availability and maintenance
We commit to 99.9% monthly availability per server, measured from our side and published on the status page; the service level agreement defines the measurement, the exclusions and the credits. Scheduled maintenance is announced at least 72 hours ahead in the console and limited to four hours per month; emergency security maintenance may be shorter notice.
11. Hardware failure
A failed card, drive, power supply or memory module is replaced from spares held in the same data centre, with a target of four hours from detection. The replacement carries the same specification. Data on a failed NVMe device may be unrecoverable; we do not attempt data recovery.
12. Prices and changes to the catalogue
The cost sheet inputs (purchase prices, power contracts, rack costs) are reviewed monthly and the date of the last review is printed on every price. New prices apply to new orders only. We may withdraw a GPU model from the catalogue with 60 days' notice to tenants renting it; their servers keep running at the locked price until they cancel or the notice period ends.
13. Suspension and termination by us
We may suspend a server, and where necessary an account, for non-payment (as described above), for a breach of the acceptable-use policy, when a legal order requires it, or when the server is attacking or being used to attack others. We keep data for 14 days after a suspension unless the law forbids it. We may end the agreement with 30 days' notice for any reason; in that case unused balance and the remainder of paid terms are refunded.
14. Liability
Apart from the credits and refunds set out in these terms and in the SLA, the service is provided as is. To the extent the law allows, we are not liable for indirect or consequential loss, lost profit, lost data or the cost of substitute services, and our total liability towards you for any claim is limited to the amount you paid us in the three months before the event. You indemnify us against third-party claims arising from what you ran on your server.
15. Privacy
What we hold about you, for how long and why is set out in the privacy policy. We disclose data only under a legally binding order in the jurisdiction where the server in question is located, and only what we hold.
16. Changes to these terms
We may change these terms with 14 days' notice in the console. Ordering, renewing or keeping a server after the notice period is acceptance of the new terms. If you do not accept them, cancel your servers before they renew and request a refund of the unused balance.
17. Law and disputes
The agreement for a given server is governed by the law of the country where that server is located, and disputes about it go to the courts of that country. We will always try to settle a disagreement through a ticket first.
